European Fundation of Human rights is not gonna give up!

On Agust 17th A.D. Prosecutor of a district of the city Klajpeda overrode the rule of discontinuance. The discontinuance was made because suspected could have not be found. European fundation of Human rights was very pleased with the desicion. An investigation starded on the basis of the clause number 170 part 4 of Penal code of Republic of Lithuania, where the clause says about public incitement to racial hatred as well as humilating commets. Those commets and incitements were seen in Lithuanian information portal : www.lrytas.lt, under the article titled “Norite dirbti Vilniaus rajono savivaldybėje? Išmokite lenkiškai” ( If you want to work Villenian locan goverment, you need to know Polish). The comment was written in the office where are working 11 persons and are 11 computers. The director of the comprany claimed he was not able to found out who it might be, because he could not check every computer.

Genereal prosecutor of a district of the city Klajpeda overrode the rule of discontinuance which was made by the Prosecutor, his decision was made because he is belived, not of all needed parts of investigation to find out the perpetrator, were made out correctly. During the investigation, the thread of criminal repsponsibility was made to the director. The director should have done evrything to make his company work corectly. Moreover, in the decision about discontinuance of the investigation there was not any explanation what kind of actions were made to find out the person who was responsible for the abusive comments against Poles.

The fundation is doing everything what’s their best to make the authors of the commets incur the consequences of their actions. The justify is blind and sometime that blindness is stronger through out the indifference of people who should fight against crime. Although, with our knowledge and previous experience we are more effective in persuading upper institutions to look in again in a case.

In total, there are 6 penalties for the commets on the basis from findings of European Fundation of Human rights, which were sent to the Prosecutor in the frame of a campain. The campainn should stop all of the people who feel nothing about the humanity of the others as well as the ones who say about the others death. To make an example about the progress we have made, in 2011 Fundation have sent 25 findings to the Genereal Prosecutor about comments, in 2012 there where almost 78 of findings.(http://www.efhr.eu/2011/08/18/european-foundation-of-human-rights-reported-a-dozen-or-so-cases-of-the-initiation-of-criminal-proceedings/?lang=en; http://www.efhr.eu/2012/08/16/efhr-has-achieved-another-success-with-respect-to-comments-on-the-web/?lang=en).

Through out sending the findigs to the institutions of justify, which have in their contents discrimination parts, Our Fundation would like to make those institutions see the problem. The state cannot just turn the blind eye on the problem in times when the hatred is bigger than ever. Effects of turnig the blind eye of the problem is seen in inquiries where the results show that lithuanian sociaiety took all bad example from politics and media about discrimination.(http://www.efhr.eu/2012/01/06/efhr-took-notice-seriously-of-the-survey-published-in-the-issue-of-iq-on-january/?lang=en).

European Fundation of Human rights would like to thank to all, who have already sent the information about discriminated comments. With out your help this success would not happened.

We encourage to the cooperation in a future.
